ARTICLE 1 - Terms and Definitions
● "Platform" refers to the infrastructures developed by Pop FiiT © including data of different natures, and in particular texts, sounds, still or animated images, videos, databases, intended to be consulted and accessible on the Web and Mobile platforms of Pop FiiT © ;
● "Personal data", "special categories of data", "process/processing" any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"); An "identifiable natural person" is deemed to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity;
● the "Controller" means the natural or legal person, public authority, department or other body which, alone or jointly with others, determines the purposes and means of the processing; where the purposes and means of such processing are determined by Union law or the law of a Member State, the controller may be designated or the specific criteria applicable to his designation may be provided for by Union law or the law of a Member State..;
● "Recipient" means the natural or legal person, public authority, department or any other body to whom personal data are disclosed, whether or not a third party. However, public authorities that may receive communication of personal data in the context of a particular investigation mission in accordance with Union law or the law of a Member State shall not be considered as recipients; the processing of such data by the public authorities in question shall be in accordance with the applicable data protection rules according to the purposes of the processing;
● "Authorized third party" means a natural or legal person, public authority, department or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or processor, are authorized to process the personal data; "Data subject" means the natural person to whom the data subject to processing relate;
● constitutes "processing of personal data" any operation or set of operations which is performed upon personal data or sets of personal data, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
ARTICLE 2 - Scope of application
The purpose of this personal data protection policy (hereinafter the "Policy") is to inform Data Subjects of how their personal data is collected and processed by Pop FiiT ©, as well as all their rights resulting from the EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, known as the "
RGPD ".
ARTICLE 3 - Processing of personal data
Within the framework of the operation of the Platforms, Pop FiiT © is likely to collect data concerning you. These data are processed in accordance with the purposes foreseen at the time of collection, namely:
- the good functioning of the platforms with regard to its functionalities;
- the operations relating to the management of the clients, the prospection, the transfer, the renting or the exchange of the clients and prospects file as well as the elaboration of statistics relating to the frequentation of the platforms;
- the execution of the contract to which the user may be party;
- the management of sponsorship operations;
- the display of targeted advertisements based on the data collected during the creation of your account. In case of use of the data for other purposes, Pop FiiT © undertakes to collect the prior consent of the persons concerned before the implementation of the processing and to specify beforehand the said purpose(s). The compulsory or optional character of the data that the Data Subjects could be led to inform will be indicated on the collection forms by an asterisk. They will be informed of the possible consequences for them if they do not answer. In any case, Pop FiiT © undertakes to process all the data collected in a way that complies with the law n°78-17 of January 6, 1978 of August 6, 2004 and with the RGPD.
ARTICLE 4 - Data controller
Personal data are collected by Pop FiiT ©, a company registered in the Geneva Trade and Companies Register under the number CHE-332.556.792 having its registered office at rue des Vollandes, 40, c/o Philgest - 1207 Geneva, represented by Mr DEYDIER, in his capacity of director of the publication.
ARTICLE 5 - Rights of the Persons concerned
It is reminded that the Persons concerned have the right to access, rectify, oppose, delete, limit and port their data, except in cases where the processing is in response to a legal obligation, to the processing of their personal data. These rights can be exercised, in accordance with the RGPD, by simple request by e-mail to the following address: support@pop-fiit.com .
ARTICLE 6 - Anonymization
The collected data are kept in a form allowing the identification of the Persons concerned during the time necessary for the purposes for which they are collected and processed. Pop FiiT © proceeds to the anonymization of the data as soon as the purpose of the processing is achieved or the user's account is closed, unless otherwise provided by law or regulation. In this case, the data are kept in accordance with the prescription periods in force.
ARTICLE 7 - Transfer of personal data
The personal data collected on the platforms are exclusively reserved for Pop FiiT ©, which may be led to communicate the personal data of the Persons concerned to ensure the support, to carry out satisfaction surveys and to conduct statistical studies. The communication of personal data will be carried out in compliance with the anonymization rules mentioned in article 6 "Anonymization". The recipients of your data are within the limits of their respective attributions:
● the authorized personnel of the marketing department, the sales department, the departments in charge of handling customer relations and prospecting, the administrative departments, the logistics and IT departments, as well as their line managers ;
● the authorized personnel of the services in charge of control (auditor, services in charge of internal control procedures...) ;
● the authorized personnel of Pop FiiT ©'s service providers intervening in the processing of your personal data, as long as the contract signed between them and Pop FiiT © mentions the obligations incumbent on the subcontractors as regards the protection of the security and confidentiality of the data (article 28 of the RGPD) and specifies in particular the security objectives that must be achieved. The following may also be recipients of data:
● partners, external companies or subsidiaries of the same group of companies, subject to prior consent, in accordance with Article 4.11 of the RGPD ;
● organizations, judicial auxiliaries and ministerial officers, in the framework of their debt collection mission. In addition, Pop FiiT © reserves the right to transmit the personal data of the Data Subjects in order to comply with its legal obligations, and in particular if it were forced to do so by judicial requisition. Pop FiiT © informs you that your data may be transferred outside the European Union. If necessary, Pop FiiT © undertakes not to transfer outside the European Union, without prior written authorization of the client and provided that the recipient country presents appropriate guarantees and provided that the persons have enforceable rights and effective legal remedies, in accordance with article 46 of the RGPD.
ARTICLE 8 - Security
In accordance with articles 34 and 35 of the law N°78-17 of January 6, 1978 modified on August 6, 2004 and with article 32 of the RGPD, Pop FiiT © implements all the technical and organizational measures necessary to guarantee the security and the confidentiality of the personal data collected and processed, and in particular to prevent them from being deformed, damaged or communicated to unauthorized third parties, by ensuring a level of security adapted to the risks linked to the processing and to the nature of the data to be protected, having regard to the level of the technology and to the cost of its implementation.
ARTICLE 9 - Sponsorship and prospecting
You can be invited, by a private contact, to join the site (sponsorship). In this case a message is sent to you, you are then informed of the identity of the sponsor. The data of the sponsored person can be used only once: to send him the commercial offer, the press article or the advertisement suggested by the sponsor. Pop FiiT © can only keep the data of the sponsored person to send him/her other messages if it has obtained his/her express consent. If you are a user, you can ask at any time to be removed from the list of e-mail addresses used for canvassing by e-mail, by sending a message, followed by an acknowledgement of receipt, to the following address: support@pop-fiit.com.
ARTICLE 10 - Applicable law
The present document is governed by Swiss law. If any provision of this Agreement is held to be invalid or declared invalid by a law, regulation or final decision of a competent court, the other provisions shall remain in full force and effect. In the event of any difficulties regarding the interpretation or performance of this Agreement, the Parties shall endeavor to resolve their differences amicably, in which case the Parties shall engage in mediation prior to commencing any legal proceedings. In case of persistent disagreement, any dispute arising from the execution or interpretation of these conditions will be submitted to the jurisdiction of the courts of the city of Colmar.

Pop FiiT © is an online service that provides online training content, sports coaching and training, through an interface allowing each user to publish information, share it and consult information published by other users. The access and the use of the Pop FiiT © online service are subject to the Terms and Conditions http://app.pop-fiit.com/media/files/conditions-generales.pdf.
